{"id":2788,"date":"2016-06-02T12:47:15","date_gmt":"2016-06-02T10:47:15","guid":{"rendered":"https:\/\/www.polyas.de\/blog\/?p=2788"},"modified":"2016-06-13T10:46:04","modified_gmt":"2016-06-13T08:46:04","slug":"fundamental-digital-rights-why-we-need-them","status":"publish","type":"post","link":"https:\/\/www.polyas.de\/blog\/en\/digital-democracy\/fundamental-digital-rights-why-we-need-them","title":{"rendered":"Fundamental Digital Rights &#8211; Why We Need Them"},"content":{"rendered":"<p>We have the chance to turn the trademark &#8220;Made in Germany&#8221; into a synonym for responsible and high quality technology which stands the test of time &#8211; in contrast to the internet giants.<br \/>\n<!--more--><\/p>\n<h3><strong>Martin Schulz Demands a Charter for Fundamental Digital Rights\u00a0<\/strong><\/h3>\n<p style=\"text-align: left;\">Last year, the President of the EU Parliament made an effort to discuss fundamental digital rights. In the newspaper <em>Die Zeit<\/em>, he calls for an open dialogue on the subject. He argues that we should think more about digital rights. He said of digitalisation, that it cannot &#8220;lead to a dangerous concentration in key areas. As the basis of democracy is plurality.&#8221; Moreover, he added that there are some internet firms which have a market share of over 90%. A \u201cwinner takes all\u201d market rule should therefore be avoided. Data is the commodity of the 21st century, thus, according to Schulz, it is of greatest importance that data is not solely in the hands of a few private companies. He warns that controlling people with Big Data becomes more and more easy. In conclusion, Schulz demands a Fundamental Digital Rights Charter which clearly defines what companies and the state are allowed to know about people. Nevertheless, he emphasises that this is not directed at successful companies like Google, Amazon or Facebook. Indeed he argues that we need creative and innovative companies such as these. Overall, Schulz advocates for a web where everybody can move freely and securely, which supports plurality and offers alternatives.<\/p>\n<h3>The Digital Fundamental Rights Charta by Heiko Maas<\/h3>\n<p>Following Martin Schulz\u2019s demands, Minister of Justice Heiko Maas created a first draft for a Fundamental Digital Rights Charter, which consists of 13 points and addresses important topics. The article by Maas, published last December in\u00a0<em>Die Zeit<\/em>, can be summarised as follows:<br \/>\n<a href=\"http:\/\/www.zeit.de\/2015\/50\/internet-charta-grundrechte-datensicherheit\" target=\"_blank\">Read the full <em>Zeit<\/em> article here.<\/a><\/p>\n<p><u>Article 1<\/u><br \/>\n<strong>Every person has the right to access to the internet<\/strong><\/p>\n<p><u>Article 2<\/u><br \/>\n<strong>Every person has the right to their own digital data<\/strong><\/p>\n<p><u>Article 3<\/u><br \/>\n<strong>Every person has the right to choose\u00a0their own digital identity, every person has right to be forgotten<\/strong><\/p>\n<p><u>Article 4<\/u><br \/>\n<strong>No person can be object of an algorithm<\/strong><\/p>\n<p><u>Article 5<\/u><br \/>\n<strong>Every person has the right to express and spread their opinion freely on the internet and to inform themselves through publicly available sources. No censorship can take place.<\/strong><\/p>\n<p><u>Article 6<\/u><br \/>\n<strong>The freedom of expression includes respecting the general principles and personal rights of fellow man<\/strong><\/p>\n<p><u>Article 7<\/u><br \/>\n<strong>Every person has the right that their services, which are created or distributed via the internet, are fairly paid for<\/strong><\/p>\n<p><u>Article 8<\/u><br \/>\n<strong>All copyright owners and performing artists have the right to a fair share of the revenue from their works which are distributed digitally<\/strong><\/p>\n<p><u>Article 9<\/u><br \/>\n<strong>The State guarantees net neutrality<\/strong><\/p>\n<p><u>Article 10<\/u><br \/>\n<strong>No one is allowed to abuse their economic power. The state prevents\u00a0monopolies\u00a0and cartels, and supports diversity and competition.<\/strong><\/p>\n<p><u>Article 11<\/u><br \/>\n<strong>Every person has the right to data security<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Article 12<\/span><br \/>\n<strong>States establish international law to secure the freedom of the internet worldwide<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Article 13<\/span><br \/>\n<strong>Every person has the right to an analogue world. No one is allowed to be unjustifiably discriminated because they do not use digital services.<\/strong><\/p>\n<p>In the <em>Die Zeit<\/em> article, Maas mentions many important points, which we as an online voting provider only welcome. The participation of people, and thus access to the internet for everyone is a significant matter for us. Moreover, it is undoubtedly important to secure the sensitive data of our clients. One of them is the EU Commissioner for Digital Economy and Society, G\u00fcnther Oettinger, who says on <em>Die Zeit<\/em> Online: \u201cWe have basic rights which are written in the Lisbon Treaty, for example. It\u2019s not about new basic rights. It\u2019s only about applying the known basic rights to digital technologies.\u201d He aims to modernise and update the current legal position, which is why he wants to adjust the existing set of rules and create standard European regulations.<\/p>\n<p>We are of the opinion that the debate about fundamental digital rights is important food for thought, and merely adjusting existing laws should not be the only answer.
